Photo Style Terms of Service

Terms governing use of the Photo Style AI photo style changer

1. Introduction and Acceptance

These Terms of Service ("Terms") govern your access to and use of Photo Style and its AI photo style changer at photo-style.app (the "Service"). By creating an account, subscribing, or using the Service, you confirm that you are at least 18 years old, have read and understood these Terms, and agree to be bound by them. If you do not agree, do not use the Service.

Our Privacy Policy explains how we handle information. Section 10, the AIGC Use Policy, is part of these Terms.

2. The Service

Photo Style lets you upload a photo, select a curated style, and request an AI-generated transformation. Available styles, features, model providers, limits, and availability may change as we improve the Service.

The current photo-style transformation pipeline uses the APINEED API to access Google Gemini 3.1 Flash Image Preview (model ID: gemini-3.1-flash-image-preview-token). The active provider or model may change as the Service evolves; the generator's model disclosure identifies the current configuration.

AI outputs are generated automatically and may be inaccurate, unexpected, or unsuitable for a particular purpose. You are responsible for reviewing an output before using or sharing it. Do not rely on the Service for medical, legal, financial, identity, safety-critical, or other professional decisions.

3. Accounts and Security

You must provide accurate information and keep your account credentials secure. You are responsible for activity under your account and must promptly notify us of unauthorized access. Do not share your account or use another person's account without permission.

4. Plans, Credits, and Subscriptions

Free users receive 10 credits after sign-up. The Pro plan is $9.90 per month and includes 100 transformations during each valid paid subscription period. The current plan details and prices shown at checkout control if they differ from this summary.

By subscribing, you authorize the payment processor shown at checkout to charge the applicable recurring fee at the beginning of each billing period until you cancel. Pro access remains available through the end of the paid period after cancellation, and cancellation prevents later renewal unless you subscribe again.

We may change plan features or prices. Changes to a recurring price will apply only after reasonable notice and, where required, will give you the opportunity to cancel before the change takes effect. Taxes may apply where required by law.

5. Cancellation

You may cancel a subscription through the billing or account settings available in the Service, or by contacting support@photo-style.app from your account email. Cancellation stops future renewal; it does not automatically create a refund for the current paid period.

6. Billing and Refunds

6.1 What can be refunded

The following paid transactions may qualify for a refund:

  • A first Pro subscription charge requested within 7 calendar days of that charge, provided no transformation has been used from that paid period;
  • A duplicate or clearly incorrect charge;
  • A charge that you did not authorize, after we complete a reasonable account review;
  • A material Service outage caused by us that lasts more than 72 consecutive hours, for a proportionate refund or service extension; and
  • Any refund, cancellation, or withdrawal right that cannot legally be excluded in your location.

The free allowance is not a paid product and cannot be exchanged for cash.

6.2 When refunds are not available

Except where required by law or covered by Section 6.1, we do not refund:

  • A paid period after a transformation has been used;
  • Requests made more than 7 days after the first subscription charge;
  • A renewal charge when you did not cancel before the renewal date;
  • Unused time after a voluntary cancellation;
  • Charges resulting from a violation of these Terms or the AIGC Use Policy; or
  • Charges caused by an account being suspended or terminated for fraud, abuse, or other misconduct.

6.3 How to request a refund

Email support@photo-style.app within the applicable period. Include the account email, transaction ID or payment receipt, date of the charge, and reason for the request. We normally acknowledge a request within 2 business days. Approved refunds are sent to the original payment method, usually within 5–10 business days depending on the payment processor and your bank.

7. User Photos, Inputs, and Outputs

You are responsible for ensuring that you have the rights, permissions, and lawful basis needed to upload a photo and request a transformation, including any necessary consent from people depicted in it.

As between you and Photo Style, you retain your rights in the photo you submit. Subject to these Terms and applicable law, you may use a generated output for lawful personal or commercial purposes. AI output may not be unique, and we do not guarantee that an output is free from third-party rights or suitable for a particular use.

You grant Photo Style a limited, non-exclusive right to process submitted photos and selected styles only as needed to provide, secure, and support the requested Service. We do not use source photos or generated results to train our own AI models. See the Privacy Policy for more information.

8. Intellectual Property

Photo Style, including its website, branding, software, curated presets, text, and original interface, is owned by Photo Style or its licensors and is protected by applicable intellectual property laws. These Terms do not transfer our intellectual property to you.

9. General Prohibited Activities

You must not:

  • Violate any applicable law, regulation, or third-party right;
  • Attempt to gain unauthorized access to the Service or its systems;
  • Interfere with, overload, scrape, or reverse engineer the Service;
  • Circumvent usage limits, safety controls, authentication, or payment systems;
  • Upload malware or other harmful code;
  • Resell, sublicense, or share access without our written permission; or
  • Use the Service to mislead, defraud, harass, or endanger others.

10. AIGC Use Policy

This section is the Photo Style acceptable use policy for AI-generated and AI-edited images. You must not upload, request, generate, or distribute content through the Service that is illegal, harmful, or violates another person's rights.

10.1 Prohibited content

Photo Style prohibits:

  • Pornographic or NSFW content: explicit sexual acts, sexualized nudity, or sexual content involving any person;
  • Violence, blood, or graphic gore: graphic injury, torture, glorification of violence, or instructions facilitating violent harm;
  • Hateful content: content that attacks, dehumanizes, or promotes discrimination or violence against a protected group;
  • Child sexual abuse material (CSAM) or child sexualization: any sexual or exploitative content involving a minor, including attempts to sexualize a real or fictional child;
  • Deepfakes or impersonation: realistic manipulation of a real person without appropriate consent, especially non-consensual sexual imagery, fraud, or content intended to mislead people about identity or events;
  • Copyright or trademark infringement: content that unlawfully copies, reproduces, or misuses another person's or brand's protected work, likeness, logo, or trademark; and
  • Other unlawful or harmful content: fraud, scams, harassment, privacy violations, doxxing, terrorism or extremist propaganda, malicious code, or instructions for wrongdoing.

You must not use prompts or uploads intended to bypass safety controls, systematically generate spam, or represent AI-generated content as human-made when that would mislead others.

10.2 Content review and safety controls

Photo Style may review request signals and generated outputs using automated safety controls provided by the Service or its AI providers. Requests may be blocked, refused, or sent for additional review when they match a prohibited category or show an abuse pattern. We may also review material reported through our contact channel when reasonably necessary. No automated system can identify every harmful or unlawful request, and users remain responsible for their submissions and use of outputs.

10.3 Enforcement

Depending on severity, confidence, and prior conduct, we may:

  • Refuse a request or prevent an output from being delivered;
  • Remove or disable access to content retained by the Service;
  • Warn the user or require a request to be changed;
  • Restrict transformation access or usage limits;
  • Temporarily suspend an account while we review an issue;
  • Permanently terminate an account for severe, repeated, or intentional violations; and
  • Preserve or disclose relevant information where required by law or necessary to protect people or the Service.

We may take immediate action for CSAM, credible threats of violence, terrorism, non-consensual intimate imagery, fraud, or other serious violations.

10.4 Reporting and appeals

To report prohibited content, suspected abuse, copyright or trademark infringement, impersonation, or a privacy concern, email support@photo-style.app with the subject "AIGC Report" or use our contact form. Include enough information to locate and review the issue, but do not send additional illegal or sensitive material unless requested.

We handle reports in good faith, prioritize urgent safety matters, and limit access to report information to what is reasonably necessary. False, malicious, or abusive reports may themselves lead to account action. If you believe your account or request was restricted in error, contact us within 14 days with the account email and relevant context so we can review the decision.

11. Suspension and Termination

We may suspend or terminate access if you breach these Terms, create security or legal risk, engage in fraud or abuse, or where necessary to comply with law or protect the Service. If we terminate a paid account for reasons unrelated to your breach, we may provide a proportionate refund for unused prepaid access where appropriate.

12. Disclaimers and Limitation of Liability

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim warranties of availability, accuracy, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

To the maximum extent permitted by law, Photo Style will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of or inability to use the Service. Nothing in these Terms excludes liability that cannot legally be excluded.

13. Changes to These Terms

We may update these Terms by posting a revised version on this page and changing the effective date above. For material changes, we will provide additional notice where required by law. Continued use after the effective date means you accept the updated Terms.
